During this phase of the foreclosure process, your lender notifies you that your loan has been referred to foreclosure. It may send you a "Notice of Acceleration" giving you 30 days to cure the alleged default. It is important that you contact Doucet & Associates Inc. after receiving this notice because it usually means a foreclosure lawsuit is imminent. Calling our firm at this stage gives us a greater opportunity to talk to you about legal options, including pre-emptively filing a lawsuit against your lender.
Defending the Lawsuit
Once a lawsuit has been filed against you, you will need to file a formal answer with the courts within 28 days. If you miss this deadline, the bank can move for default judgment against you. Don't rely on the timeline provided by the court for trial, as failing to answer will likely result in an immediate loss, a sale of your home, and closure of the case. Don't delay in talking to a lawyer once you have been served.
